The misidentification of human remains is becoming a growing concern in the funeral industry. The box began to smell and leaked into the family’s car, causing emotional distress for the parents.
Following the discovery, the family filed a lawsuit against both funeral homes involved, claiming negligent handling of human remains and intentional infliction of emotional distress. According to the family’s lawyer, the funeral homes should have identified the box and not handed it over to the family. It is unknown at this time if the brain will be buried with the rest of the remains.
