A man who was wrongly deported from the US to El Salvador has been detained by Immigration and Customs Enforcement (ICE) again. Kilmar Abrego Garcia, a 30-year-old from El Salvador, voluntarily turned himself into the ICE field office in Baltimore, Maryland, for a required check-in on Monday. This was a condition of his release from federal custody over the weekend; however, in a court filing on Saturday, his lawyers stated that they anticipated Garcia would be detained again upon attending. Garcia is facing charges of conspiring to transport undocumented immigrants into the US, as outlined in a federal court indictment in Tennessee.
Garcia’s case has drawn attention due to his initial wrongful deportation from the US to El Salvador in March. Following his return to the US in June, the Trump administration detained him on criminal charges that were filed in May. The criminal indictment alleges that Garcia collaborated with at least five co-conspirators to smuggle immigrants into the United States and transport them from the border to various locations within the country.
Days after his release on Friday, immigration officials notified Garcia of their intention to deport him to Uganda. This situation is further complicated due to his marriage to an American citizen and the presence of their children in the US. His lawyers have filed a challenge to the deportation order, arguing for due process to contest the removal attempt.
This case highlights the complex interplay between immigration laws, criminal charges, and the consequences of administrative errors in the immigration system.
