The Trump administration is seeking to challenge a block on its use of the Alien Enemies Act of 1798 to deport undocumented immigrants in a federal appeals court. However, one judge on the court appeared to question the lack of due process given to these individuals under the law. Judge Patricia Millett stated that Nazis received better treatment under the Alien Enemies Act than what has been seen in this case. Government lawyer Drew Ensign disputed this comparison. Millett is one of three judges on the US Court of Appeals for the District of Columbia Circuit, with the other two judges chosen by Republicans. The Trump administration is trying to lift a two-week injunction on its use of the Alien Enemies Act, which has only been invoked three times prior, including during World War II when it was used to imprison Japanese Americans.
