A South Wales police officer driving a van that pursued two teenage boys before their fatal e-bike crash in Cardiff will not be charged criminally, according to prosecutors.
The Crown Prosecution Service announced that it will not be pursuing criminal charges against the officer involved in the deaths of Harvey Evans, aged 15, and Kyrees Sullivan, aged 16, which occurred in Ely, Cardiff, on May 22, 2023. The teens crashed on a Sur-Ron bike shortly after being chased by a police van captured on CCTV.
The crash led to hours of unrest in the city, including violent confrontations with police and damage to property. Malcolm McHaffie, head of the Crown Prosecution Service special crime division, expressed condolences to the families and friends of the deceased youngsters.
McHaffie explained that following an exhaustive examination of the evidence regarding the allegation of dangerous driving, there is insufficient evidence to ensure a realistic chance of conviction. He acknowledged that this decision may be disappointing for the boys’ families and offered to meet with them to provide a more detailed explanation of their reasoning.
The decision is subject to the victim’s right of review (VRR) scheme, which provides victims or their families with a process to challenge certain CPS decisions not to prosecute or to halt a prosecution in specific cases.
The deaths of the two teen boys sparked a night of violent disorder that left 15 police officers injured. Rioters claimed they had assembled to pay their respects to the deceased before clashes erupted with the South Wales police.
