Kristian White will continue serving his sentence in the community for the manslaughter of Clare Nowland, a 95-year-old great-grandmother, after New South Wales prosecutors failed to appeal against his community sentence.
White, a former NSW police officer, Tasered Nowland just two minutes and 40 seconds after arriving at the Yallambee Lodge nursing home in response to a callout in May 2023. Nowland fell and later died in hospital a week after.
White was found guilty of manslaughter in a jury trial and sentenced to a two-year good behaviour bond and community service in March. The NSW Office of the Director of Public Prosecutions announced it would appeal against “the inadequacy of the sentence imposed in this matter”.
The incident was deemed to fall in the lower end of objective seriousness for manslaughter by Justice Ian Harrison, who ruled that time in prison would be disproportionate. Nowland’s eldest son called the ruling “a slap on the wrist” for someone who had killed their mother.
