UK’s Home Office advises parents to send their children back to Brazil by themselves | Immigration and asylum issues

A Brazilian mother and father are in a state of distress after they were notified by the Home Office that their young children should return to Brazil on their own, despite the parents having the legal right to live and work in the UK. The children have lived in the UK for most of their lives, with their mother, an NHS nurse, and father, a senior lecturer in computer science. The Home Office’s letter warns one of the children that staying in the UK without permission could lead to detention, prosecution, and other serious consequences. The parents are up in arms as their children do not speak Portuguese fluently, could lose their place at a grammar school, and could experience emotional and social disruption. The family’s situation has arisen because the parents divorced after their arrival in the UK. The Home Office rules dictate that both parents should be granted settlement at the same time or be settled or a British citizen, but this is not the case in this scenario.
